Promotion is not basic right of a govt employee, declares LHCBreaking

The Lahore High Court (LHC) has declared the Promotion Policy 2010 Section 21 as in accordance with law and said that the government’s policy in this regard is as per law.In its verdict, the LHC said that considering the names of those officials who are availing LPR for promotion is not illegal.The LHC verdict stated that promotion is not a basic right of a government employee. The law allows only to consider the name for promotion.

 The employee who is on LPR is not considered functional in his service. Only the government can determine qualifications and terms and conditions for the promotion. Justice Mohammad Sajid Mehmood Sethi issued the verdict on the petition filed by government employee Hafeezur Rehman. The petitioner challenged Promotion Policy 2010 Section 21. The petitioner was performing his duty as a senior scientist in the agriculture department. He went on LPR before his retirement.

The Provincial Selection Board dismissed the case of the petitioner on March 14, 2024. The petitioner prayed to consider his name for promotion while availing LPR facility. The Court verdict said that the decision to allow LPR is a man’s choice. The Court said that demanding promotion while availing LPR is not legal. The Provincial Section Board rejected his appeal.
