October 25, 2024

Senior Judge of the Supreme Court, Justice Mansoor Ali Shah, has formally declined to participate in a full court reference honoring Chief Justice Qazi Faiz Isa, citing serious concerns over the judiciary's integrity and external influences. In a letter addressed to the Registrar of the Supreme Court, Justice Shah outlined his reasons for abstaining from the ceremony, stating that such references are typically reserved for retired Chief Justices who have served the judiciary with distinction. He emphasized that his previous refusal to attend a reference for former Chief Justice Saqib Nisar stemmed from similar concerns regarding the misuse of judicial power. Justice Shah expressed that the current circumstances surrounding Chief Justice Isa are equally troubling.

He criticized Justice Isa for allegedly failing to protect judicial independence, claiming that instead of curbing external interference, the Chief Justice has allowed it to permeate the judiciary, thereby undermining its authority. Furthermore, Justice Shah reiterated his refusal to join a special bench, reiterating his stance against participating in any judicial proceedings until a full court review of recent amendment ordinances is conducted. In his letter, he stressed the importance of accountability within the judiciary, reminding his peers that their actions are being observed by the public and will be judged by history. Quoting Sir Thomas More, Justice Shah underscored the need for judges to remember their responsibilities to the people and the ethical standards expected of them. His firm stance has sparked discussions regarding the future of judicial governance and the role of Supreme Court justices in safeguarding the rule of law in Pakistan.
